Louisiana temporarily eases dyed-diesel penalties for farm and forestry vehicles

Staff Writer · 2026-10-03

Louisiana Executive Order JML 26-090 suspends the state penalty for qualifying Class 2 forest-products and Class 5 farm-use vehicles using dyed diesel during harvest operations through October 22, 2026.

The temporary relief applies to vehicles registered with the Louisiana Office of Motor Vehicles as Class 2 for forest products or Class 5 for farm use when they are used during harvesting operations. It allows affected farmers and timber harvesters to use dyed diesel already kept for off-road equipment without the usual state penalty during the emergency period.

The order does not create a general dyed-diesel exemption for other vehicles or uses. Operators should confirm that the vehicle has the qualifying registration class and that the fuel use is connected to covered harvest work before relying on the order.

The state relief runs through October 22, 2026. The order also directs the Louisiana Department of Revenue to request a comparable federal penalty waiver from the Internal Revenue Service; the governor's announcement does not say that federal relief has already been granted, so operators should separately verify federal tax treatment.
