Treasury proposes rules for large investors buying single-family homes

By Staff Writer · Published 10/22/2026, 11:11:24 AM ET

The proposal describes exceptions and enforcement under a housing law whose purchase restrictions begin January 7, 2027, according to Treasury.

The Treasury Department proposed regulations October 22 setting out how it would apply federal restrictions on large institutional investors buying single-family homes. Treasury said the law’s general restriction on purchases and purchase contracts begins January 7, 2027, while allowing several categories of exceptions.

According to the department, the 21st Century ROAD to Housing Act uses a threshold of 350 single-family homes under an entity’s investment control, directly or indirectly, as part of its large-investor definition. The business must also engage in activities involving those properties. The proposed regulations would clarify that business test and when a passive investor falls outside the rules.

Treasury’s plan also addresses purchases tied to new rental construction, rehabilitation of neglected homes and programs that help renters become homeowners. It proposes ways to satisfy requirements involving substantial rehabilitation, financial support for a renter’s home purchase and opportunities for tenants to buy a property before other buyers.

Other provisions cover certain debt and loss-mitigation transactions, transfers between institutional investors and the calculation of civil penalties. The department said its approach is intended to clarify how the law applies without unnecessarily disrupting construction, rehabilitation or housing-market financing.

The regulations remain a proposal. Treasury invited public comments within 30 days after the notice appears in the Federal Register; its October 22 release did not state a calendar deadline. The release links the proposed text, and commenters should consult the published notice for submission instructions and the final comment date.

What it means

The announcement opens a rulemaking process about how the purchase restrictions and exceptions would work. For investors, builders and rental-home operators, the proposed definitions matter because they would determine which transactions meet an exception. Treasury’s release does not establish that the proposal has reduced home prices or guaranteed a particular result for individual buyers.
